BforKai and our Affiliates (together referred to as “BFK“, “we“, “us“, and “our“) respect your privacy and are committed to safeguarding the Personal Information that we obtain from all users and potential users of our Website (together, the “Users“, “you“, and related pronoun forms).

This Privacy Policy governs the Personal Information Collected during the provision of our Services that are made available on or through our website, https://menBaware.ca/, other BFK websites, our Social Media accounts, other digital platforms, or in any other manner or form as may be amended, expanded, updated, or introduced from time to time at our sole discretion (collectively, the “Website“).

This Privacy Policy describes how we may Collect, Use, and Disclose your Personal Information. Please read this Privacy Policy carefully to understand our policies and practices relating to your Personal Information. If you have any questions about our Collection, Use, or Disclosure of Personal Information, please contact our Privacy Officer using the information provided in Section 9.1.

The Website is not intended for children under 13 years of age. No one under such age may provide any Personal Information to or on the Website. We do not knowingly Collect Personal Information from children under such age. If we learn we have Collected or received Personal Information from a child under such age without verification of parental consent, we will delete that Personal Information. To the extent that a conflict exists between the terms of this Privacy Policy and the terms of a Supplementary Agreement, the terms of the Supplementary Agreement shall govern.

“Affiliate” means any subsidiaries, parents, agents, directors, officers, employees, contractors, subcontractors, and other related third parties of BFK.

“Collection“, “Collected“, “Collects” or “Collect” means the act of gathering, acquiring, or otherwise obtaining Personal Information from any source.

“Disclosure“, “Disclosing“, “Disclosed” or “Disclose” means making Personal Information available to others, whether within BFK or externally.

“BFK“, “we“, “us” or “our” has the meaning provided in Section 1.1.

“Personal Information” means any information about an identifiable individual. It can include but is not limited to an individual’s name, home address, phone number, email address, age, sex and/or gender, marital or family status, an identifying number, financial information, educational history, technical information (including device and browser type), IP address, and location. Personal Information does not, however, include certain business contact information used for employment, business, or professional purposes, nor does it include de-identified information used for statistical purposes.

“Server” has the meaning provided in Section 6.1.

“Service Provider” means any individual or other legal entity (including a business) who assists or partners with BFK for the delivery of the Services, who is hired by BFK for internal administrative or marketing purposes, who partners with BFK for marketing or promotional purposes in connection with the Services, or who Collects and processes data on behalf of BFK. For greater clarity, this includes third-party companies or individuals who enter into a contractual service relationship with BFK to facilitate the Services, to provide the Services on behalf of BFK, to perform services related to the Services, to assist BFK in analyzing how the Services are used, to advise BFK on how to better market and deliver the Services, to provide marketing and / or promotional services to BFK, to Collect and / or process data on behalf of BFK, and to help BFK create industry partnerships so we can improve our Services. Examples of Service Providers include but are not limited to third-party marketing agencies who may assist BFK with marketing efforts and data analytics platforms such as Google Analytics.

“Services” means the online services we provide through our Website. This includes fundraising and awareness-raising for the MenBaware Campaign which aims to increase awareness of the meningitis B disease, its risks, and the protection gap across youth aged 16-25, their families, and post-secondary institutions, and any other related services offered on or through the Website.

“Social Media” means any social media account affiliated with a dedicated website or other application, which enables users to communicate with each other by posting information, comments, messages, and images. Social Media platforms include but are not limited to Facebook, Instagram, Twitter, TikTok, and any other equivalent or similar platforms existing now or in the future.

“Supplemental Agreements” means any terms and conditions, rules, policies, or any other agreement, whether click-through or otherwise, made between you and BFK that are supplemental to or supersede any one or more terms in this Privacy Policy.

“Use“, “Uses“, or “Used” means handling, analyzing, modifying, compiling, sharing, transferring, or otherwise applying Personal Information for any given purpose.

“User” or “you” has the meaning provided in Section 1.1

“Website” has the meaning provided in Section 1.2

BFK recognizes the importance of obtaining consent where and as required by law for the Collection, Use and Disclosure of Personal Information.

By accessing or using the Website and / or Services, or otherwise submitting your Personal Information to us, you consent to our Collection, Use and Disclosure of your Personal Information for the purposes and in the ways described in this Privacy Policy. If you do not agree with our policies and practices, you may choose not to use or engage with us or with our Website and Services.

If we wish to Collect, Use, or Disclose your Personal Information in any way or for any new purpose not included in this Privacy Policy, we will ask for your consent to do so, unless consent is not required by the applicable law. For greater clarity, we may ask for your consent by updating this Privacy Policy in accordance with Article 10 or by requesting additional consent for specific events or initiatives using a Supplementary Agreement.

Where you have provided your consent to the Collection, Use, and Disclosure of your Personal Information, you also have the legal right to withdraw and modify your consent, whether in whole or in part. To do so, please contact our Privacy Officer using the information provided in Section 9.1. You may also unsubscribe from all email communications by clicking “unsubscribe” in your next email from BFK and unfollow BFK or any of our Services on Social Media.

When you engage with the Website or our Services, we may Collect certain categories of Personal Information from you from a variety of sources including through:

1. direct interactions with you when you provide your Personal Information to us (for example: by filling in forms or corresponding with us by phone, email, Social Media, or otherwise);

3. the posts that you make on or in which you tag our Website and / or Social Media; and

Categories of Personal Information that we may actively Collect from you directly include:

1. name;
2. age and/or date of birth;

4. Social Media account information (for example: when accessing our Website, you may be given the option to link with one or more Social Media accounts for sharing our Website); and
5. any other information you directly provide to BFK during your interaction(s) with us, our Services, and the Website as set out in Article 5.

For greater clarity, though information about a User’s session while accessing the Website may be Collected, BFK does not link the information above with any identifiable personal information and the individual user remains anonymized.

The Personal Information we Collect will only be Used for the purposes of the Services. This may include the following:

2. to allow Users to participate in our Services and interact with our Website, including any interactive features available through the Website, such as Social Media;

For greater clarity, BFK does not sell or otherwise share your Personal Information except as necessary to carry out our Services. While this may mean sharing your Personal Information with our Affiliates and Service Providers, we will not share your Personal Information with other similar funding partners.

The Website also uses Google Analytics, a web analytics service, and Google Tag Manager, a website tag manager, both provided by Google, Inc. (“Google“). Google Analytics and Google Tag Manager use cookies that help us analyse how Users use the Website. The information generated by the cookies about your use of the Website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of this Website, compiling reports on Website activity, and providing other services relating to Website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of the Website. By using this Website, you consent to the processing of your data by Google in the manner and for the purposes set out above.

If you navigate to other BFK websites, you may be able to make donations and purchase BFK merchandise. In doing so, you may have to provide us with payment information as part of the Personal Information we require from you to facilitate your desired transactions. In these limited circumstances, please be aware that BFK, its Affiliates, and its Service Providers do not store any payment information used in connection with such purchases or donations.

1. Payments for BFK merchandise are processed using Shopify Platform Services, and you will be required to provide certain information for identification and verification, such as your name, credit, debit, or other card number, card expiration date, and card security code.
2. Donations are processed using Zeffy (formerly Simplyk), and you will be required to provide certain information for identification and verification, such as your name, credit, debit, or other card number, card expiration date, and card security code.

If you are directed to the third-party payment gateways noted above to make payments, the privacy policy, terms of use, refund policies, complaint mechanisms and any other applicable policies of the third party will govern any complaints or breaches in respect of Personal Information provided thereto. In other words, BFK will not be responsible for any privacy breaches arising out of your use of a third-party website linked or directed through the Website.

The security of your Personal Information is important to us. We use physical, electronic, contractual, and administrative measures appropriate for the sensitivity of the Personal Information and designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. We may use Service Providers and personnel to adopt and maintain the appropriate level of security and to help prevent any loss, misuse, or unauthorized modification. Such Service Providers and personnel will be required to comply with relevant privacy laws and with this Privacy Policy.

We retain Personal Information only so long as is reasonable to fulfil the purposes for which the Personal Information was Collected or for legal or business purposes. When the purposes for which the Personal Information was Collected have been satisfied, we use appropriate security measures to destroy the Personal Information we have in our possession, including permanently deleting electronic records.

We may anonymize your Personal Information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

BFK processes and stores your Personal Information using Amazon Web Services (the “Server“). The Server is hosted in Canada but the Personal Information stored in the Server may be in Vancouver, Toronto, and / or Montreal. Additional information about our Server or Server locations can be obtained by contacting our Privacy Officer using the information provided in Section 9.1.

BFK has also put in place the following security measures in place to protect the loss, misuse, and unauthorized alteration of the information under our control:

1. a firewall to filter inappropriate access to the Server;
2. the logging of all Server access, including date, time, IP address, and username (if entering a restricted area);
3. regular backups and updates of the Website and other digital platforms;
4. SSL encryption to transmit data
5. securely to the Server; and
6. limited accessibility to Personal Information for only those authenticated and authorized users. For greater clarity, these users may include Directors of BFK, our Affiliates, and our Services Providers as well as the BFK, Affiliate, and Service Provider personnel who work on or otherwise assist with the Services or Website.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted in this manner. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website or the Server.

BFK makes every reasonable effort to ensure that your Personal Information is accurate and complete. We rely on Users to notify us of any changes to their Personal Information that may affect their relationship with us. Upon your request, we will correct your Personal Information on all our databases where reasonably possible.

We do not endorse or otherwise accept responsibility for the content or privacy policies of these third-party websites, services, and platforms and you should carefully review the privacy statements and other terms of use for them.
